A court has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment lacks legal authority.

"Since his release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her order.

The case stems from a erroneous deportation to El Salvador in March, which US authorities later acknowledged was an mistake. Following his return to the United States to face alien smuggling allegations, he was held in immigration detention.

In her decision, the judge noted that the authorities lacks a current removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."

The court proceedings involve disputed assertions. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this allegation.
